Privacy Policy (Data Processing Notice)

This notice explains how Breedwell Europe Kft. (“Breedwell”, “we”, “us”) processes personal data in connection with the breedwell.eu online store, in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Hungarian law. It is effective from the date of publication until withdrawal.

We have not appointed a data protection officer, as we are not required to do so under Article 37 GDPR. Privacy enquiries should be sent to the email address above.

2. Processing activities

Below we set out, for each purpose, the personal data processed, the legal basis, and the retention period.

a) Webshop orders and customer account

  • Purpose: registration and management of a customer account, conclusion and performance of the sales contract, fulfilment of orders, contact regarding the order.
  • Data: name, email address, phone number, billing address, shipping address, order and account data.
  • Legal basis: performance of a contract — Article 6(1)(b) GDPR.
  • Retention: for the lifetime of the customer account, or until you request deletion; data needed to establish, exercise or defend legal claims may be retained until the relevant limitation period expires.

b) Invoicing and accounting

  • Purpose: issuing invoices and meeting accounting and tax obligations.
  • Data: billing name and address, tax number (for businesses), data content of the invoice.
  • Legal basis: legal obligation — Article 6(1)(c) GDPR (Act C of 2000 on Accounting).
  • Retention: 8 years (Section 169 of Act C of 2000 on Accounting).

c) Card payment processing

  • Purpose: processing card payments made at checkout.
  • Data: name, email address, billing address, order amount, currency, and the data needed to process the card payment.
  • Legal basis: performance of a contract — Article 6(1)(b) GDPR.
  • Processors / recipients: Shopify (Shopify Payments) and Stripe Payments Europe, Ltd. (see Section 3). Full card details are entered directly with the payment provider; we do not store full card numbers.

d) Delivery

  • Purpose: delivery of ordered products and shipment tracking.
  • Data: name, shipping address, phone number, email address.
  • Legal basis: performance of a contract — Article 6(1)(b) GDPR.
  • Processor / recipient: our delivery carrier (see Section 3).

e) Newsletter and marketing

  • Purpose: sending newsletters, offers and marketing messages to subscribers.
  • Data: name, email address (and, if provided, other contact details).
  • Legal basis: your consent — Article 6(1)(a) GDPR. You may withdraw consent at any time, free of charge, via the unsubscribe link or by emailing us; withdrawal does not affect the lawfulness of processing before withdrawal.
  • Retention: until you withdraw consent (unsubscribe).

f) Complaint handling

  • Purpose: recording and handling consumer complaints.
  • Data: name, contact details, and the content and supporting information of the complaint.
  • Legal basis: legal obligation — Article 6(1)(c) GDPR (Section 17/A of Act CLV of 1997 on Consumer Protection).
  • Retention: 5 years (Section 17/A(7) of Act CLV of 1997).

g) Security and fraud prevention

  • Purpose: ensuring the security of the store, preventing and detecting fraud and abuse.
  • Data: order, device and transaction data necessary for these purposes.
  • Legal basis: our legitimate interest in operating a secure store and preventing fraud — Article 6(1)(f) GDPR.

3. Processors and recipients

We use the following processors to operate the store. They process personal data on our behalf, under contract and on our instructions.

  • Shopify International Limited (Dublin, Ireland) — e-commerce platform and hosting provider for breedwell.eu, and provider of Shopify Payments.
  • Stripe Payments Europe, Ltd. (Ireland) — payment processor for card payments made via Shopify Payments. Stripe and the relevant financial institutions may also act as independent controllers for certain regulatory purposes (e.g. anti-fraud and anti-money-laundering).
  • Our delivery carrier — DHL — for the delivery of orders. (If we use additional carriers in a given market, the carrier handling your order acts as recipient for the delivery data above.)

4. International data transfers

Our processors are located in the EU/EEA where possible. Where personal data is transferred outside the EEA (for example to group entities or sub-processors of our service providers), such transfers are safeguarded by appropriate measures, in particular the European Commission’s Standard Contractual Clauses.

5. Your rights

Under the GDPR you have the right to: access your personal data; request rectification of inaccurate data; request erasure; request restriction of processing; data portability; object to processing carried out on the basis of legitimate interest or for direct marketing; and withdraw consent at any time where processing is based on consent.

To exercise any of these rights, contact us at support@breedwell.eu. We will respond without undue delay and in any case within one month of receiving your request, in accordance with Article 12(3) GDPR.

6. Cookies

Our store uses cookies and similar technologies. Cookies strictly necessary for the operation of the site (for example, maintaining your session and the contents of your cart) are used on the basis of our legitimate interest. Analytics, marketing and other non-essential cookies are used only with your consent, which you give via the cookie banner and can change or withdraw at any time through the cookie settings or your browser. You can also block or delete cookies in your browser settings, although some features of the store may then not work properly.

7. Data security

We take appropriate technical and organisational measures to protect personal data against unauthorised access, alteration, disclosure or destruction, and we require our processors to do the same.

8. Remedies and complaints

If you have a concern about how we process your personal data, please contact us first at support@breedwell.eu so we can resolve it. You also have the right to lodge a complaint with the supervisory authority, or to seek a judicial remedy.

We may update this notice from time to time. The current version is always available on breedwell.eu, and material changes will be communicated as required by law.
